Bismarck, ND – Attorney General Drew H. Wrigley today joined Arkansas Attorney General Tim Griffin, Missouri Attorney General Andrew Bailey, an Arkansas high school athlete, and a coalition of three other state attorneys general filing suit in the U.S. District Court for the Eastern District of Missouri against the U.S. Department of Education over its new rule interpreting Title IX.

Congress enacted Title IX more than 50 years ago to protect and promote opportunities for women and girls in education and sports. President Biden and his Department of Education are now casting aside the work of Congress and radically reinterpreting Title IX as a rule about subjective gender identity.

The rule being challenged requires schools and universities to allow men onto women and girls’ sports teams undermining safety and privacy, and robbing young female athletes of opportunities. The Biden Administration rule forces schools and universities to allow men into women and girls’ locker rooms, restrooms, and shower facilities. It also compels teachers, administrators, and even fellow students to use an individual’s preferred pronouns, subjecting anyone who disagrees with President Biden’s view of sex to investigation and possible sanction.

In addition to Attorney General Wrigley, the attorneys general of the following states Iowa, Nebraska, and South Dakota also signed on to the lawsuit filed by lead states Arkansas and Missouri.
