The North Dakota Attorney General’s Gaming Division administers licensing for charitable gaming and regulates the businesses and organizations that participate in games of chance in North Dakota. State law requires proper authorization before any game of chance may be conducted, and different approvals are required depending on the activity.

Overview

Beginning Fiscal Year 2027, charitable gaming organizations will now apply for and renew their licenses through the Charitable Gaming Organization Portal, which is part of the existing Charitable Gaming Organization Tax Return System. This updated system integrates licensing, renewals, and tax reporting into one online portal for charitable gaming organizations.  Important: The Charitable Gaming Organization Portal is designed for use with a desktop or laptop computer using a supported web browser. Compatibility with tablets and mobile devices cannot be guaranteed.

Gaining Additional Access

Organizations may allow additional individuals to assist with licensing in the portal. If you would like additional individuals to assist with licensing, they will need to create their own NDLogin accounts and request access to your organization’s account within the portal. Once this is completed, please submit documentation from your governing board authorizing these individuals for system access to our office. Please include their name, title, and NDLogin username so we can review and approve the requests ahead of the April 15 launch date. You can submit this directly to agogaming@nd.gov.

Manufacturer of Gaming Equipment/Supplies

Manufacturer Licensing

 

To become a licensed manufacturer of charitable gaming equipment and supplies in North Dakota, you must complete and submit an application through our online Charitable Gaming Manufacturer Portal.

At the time of application, you must:

  • Pay all applicable licensing fees via ACH (electronic bank transfer). Setup instructions are available under the “Help” tab in the navigation bar once you enter the portal.
    Credit card payments are not available at this time.
  • Upload all required supporting documentation.

 

Manufacturer License Fees

 

License fees are based on the type of equipment manufactured:

  • $1,500 — Manufacturer of paper pull tab dispensing devices
  • $5,500 — Manufacturer of pull tabs, bingo cards, electronic quick shot bingo systems and devices, or bingo card marking devices
  • $10,000 — Manufacturer of electronic pull tab systems or devices
  • $1,000 — Manufacturer of electronic raffle systems

 

Required Documents to Upload (As Applicable)

 

  • Facility / Premises: Lease or rental agreement (required if you do not own the premises used to manufacture gaming equipment). Please note, you may only upload one in the lease agreement section. For all other lease/rental agreements, you will upload them in the attachments section.
  • Electronic Pull Tab Device Manufacturers: License Bond for Manufacturer of Electronic Pull Tab Devices (SFN 61499), $50,000 surety bond payable to the North Dakota Attorney General
  • Business Type Documentation: North Dakota Corporate Certificate, Certificate of Organization, or Partnership Registration (as applicable)
  • Manufacturer Information: Legal business name; DBA (Doing Business As), if applicable; type of manufacturing business; physical address; and mailing address (if different)
  • Corporate Officers (all officers must be entered): Full name, phone number, email address, title/position, date of birth, state of residence, and date of last record check. You will also need to select one corporate officer as the Primary Contact.
  • Shareholders (all shareholders must be entered): Full name, date of birth, date of last record check, and percentage of ownership/share. Shareholder percentages must total 100% before your application can be submitted.
    • If shareholders are a company, enter the company name in both the first and last name columns. You can use the date of incorporation for your “birth date”.
  • Locations: List the name and address of each location in Canada and the United States where any of the following occurs: manufacturing, warehousing, selling, or promotion of gaming equipment and supplies.
  • Sales Representatives in ND: Full name, date of birth, and date of last record check if available.
  • A Request for Record Check may be completed for each of the manufacturer’s partners if a partnership, each stockholder owning ten percent or more of the outstanding voting common stock of a corporation, including the corporation’s parent or subsidiary corporation, if any. You can furnish the date of the record check during application if you have them available.
    • If a record check has been completed within the last year, they may provide the results of this record check as valid.
    • If no record check has been completed, please leave this section blank. It is NOT required for many positions for Manufacturers, so please ignore these sections.

 

Processing Time

 

Processing times vary depending on whether the submission is a new or renewal application.

  • New Applications: Please allow approximately 4–6 weeks for processing, which includes completion of required record checks.
  • Renewal Applications (previously licensed applicants): We anticipate a processing time of 1–2 weeks.

 

Please note that processing times may be extended if a high volume of applications is received. If your application has exceeded the timeframes listed above, you may check on its status by emailing agogaming@nd.gov or calling (701) 328-4848.

Distributor of Gaming Equipment/Supplies

Distributor Licensing

 

To become a licensed distributor of charitable gaming equipment and supplies in North Dakota, you must complete and submit an application through our online Charitable Gaming Distributor Portal.

At the time of application, you must:

  • Pay the $2,000 distributor license fee through ACH (electronic bank transfer). Setup instructions are available under the “Help” tab in the navigation bar once you enter the portal. Credit card payments are not available at this time.
  • Upload all required supporting documentation.

 

Required Documents to Upload (As Applicable)

 

  • Facility / Premises: Lease or rental agreement (required if you do not own the premises used to manufacture gaming equipment). Please note, you may only upload one in the lease agreement section. For all other lease/rental agreements, you will upload them in the attachments section.
  • Business Type Documentation: North Dakota Corporate Certificate, Certificate of Organization, or Partnership Registration (as applicable)
  • Distributor Information: Legal business name; DBA (Doing Business As), if applicable; type of business; physical address; and mailing address (if different)
  • Regulatory History: Whether the applicant has ever been denied, suspended, revoked, or otherwise disciplined regarding any gaming license, or cited for, charged with, or found in violation of any gaming law or regulation. Supporting documentation must be uploaded to verify any “Yes” responses.
  • States Licensed: All states in which the applicant is currently licensed as a Gaming Distributor.
  • Locations: List the name and address of each location in Canada and the United States of all offices, warehouses, and any other distribution locations.
  • Corporate Officers (all officers must be entered): Full name, phone number, email address, title/position, date of birth, state of residence, and date of last record check. You will also need to select one corporate officer as the Primary Contact.
  • Shareholders (all shareholders must be entered):Full name, date of birth, date of last record check, and percentage of ownership/share. Shareholder percentages must total 100% before your application can be submitted.
    • If shareholders are a company, enter the company name in both the first and last name columns. You can use the date of incorporation for your “birth date”.
  • Employees: Full name, date of birth, and date of last record check.
  • A Request for Record Check shall be completed by each owner, partner, corporate officer, employee, and member or shareholder of 10% or more and each sales representative, within 21 days of employment. You will be asked to furnish the date of the completed record check during application for each.
    • If a record check has been completed within the last year, they can provide the results of this record check to satisfy this requirement.

 

Processing Time

 

Processing times vary depending on whether the submission is a new or renewal application.

An organization or group of people who want to hold a gaming fundraiser (such as a raffle or poker event) need to apply to the city or county for a Local or Restricted Event Permit. The following state forms must be used by city or county officials issuing the local permit:
