The Devils Lake City Commission held an executive session purportedly for negotiation strategy and to review and discuss the City Police Department’s Operations Assessment Report. The commission then reconvened in a public meeting and passed a motion to place the police chief and police captain on administrative leave. Except for a brief reference to medical records, the commission’s discussions during the 90 minute executive session related to personnel issues and job performance. 

Personnel issues and job performance are not protected and a governing body may not hold an executive session to discuss them even though they may be unpopular or controversial topics. The Commission violated the law. 2017-O-03
