BISMARCK, ND – The Consumer Protection division obtained a civil judgment against unlicensed contractor John F. Moser III, doing business as J3 Construction, LLC, banning Moser from doing business in the state.
Moser and his company J3 Construction, LLC, took advance payments from several homeowners in Ward County for barn construction, roofing, and remodeling, but did not complete the work or provide any refunds. The Ward County District Court found that Moser was operating without a contractor’s license, abandoned consumer projects, failed to provide refunds, diverted consumer refunds, and engaged in consumer fraud. The court’s judgment includes $12,439.84 in civil penalties, fees, and costs to the Attorney General’s Office.
The court banned Moser from working as a contractor for a minimum of five years, and until he has paid in full all consumers to whom he owes restitution as well as the civil penalties, and thereafter he cannot work as a contractor unless properly licensed.
In separate small claims cases, Moser has been ordered to pay approximately $30,000.00 to consumers.
