NORTH DAKOTA FILES PETITION SEEKING TO OVERTURN WASHINGTON STATE LAW

Attorney General Wayne Stenehjem announced today that North Dakota has filed a petition with the US Department of Transportation seeking to overturn a recently passed Washington State law.
MEETING NOTICES MUST BE PROPERLY POSTED

The Linton Industrial Development Corporation violated the law because it failed to provide proper public notice of its meeting. Notices must be publicly posted at the same time the governing body is notified, and must be posted on the entity’s website or filed with the auditor.
BELCOURT SCHOOL DISTRICT DID NOT VIOLATE LAW

The Belcourt School District #7 did not violate the open meetings law when each board member individually filled out an evaluation of the superintendent’s job performance; because the board members did not receive input from any other member, such action did not involve a quorum.

The Beulah Public School did not violate the open meetings laws when three board members separately contacted the Superintendent with questions about an audit, because the discussions did not involve a quorum.

STENEHJEM STATEMENT IN RESPONSE TO 8TH CIRCUIT DECISION

In an opinion issued today, the United States Court of Appeals for the Eighth Circuit has affirmed the preliminary injunction blocking the proposed acquisition of Mid Dakota Clinic by Sanford Health, which injunction was issued by the US District Court in the antitrust case brought by Attorney General Wayne Stenehjem and the Federal Trade Commission on June 11, 2017.
