NO DELAY IN SAME DAY RESPONSE

In determining whether a response to a records request is made within a reasonable time, the law looks at when the public entity receives the request, not the date it was mailed. A response made on the same day the request was received by the public entity was not unreasonably delayed.

NATIONAL PRESCRIPTION DRUG TAKE BACK DAY

Saturday October 28, 2017, is national prescription drug “Take Back Day.” Attorney General Wayne Stenehjem reminds North Dakota residents who want to safely dispose of unused prescription and over the counter medications that they can turn to the state’s free, year-round Take Back program.


SPA D'ATHENA GIFT CARDS

The consumer protection division has initiated an investigation relating to Spa D’Athena in Bismarck. Although the investigation is at a preliminary stage, Stenehjem encourages all consumers who have gift cards to file a consumer complaint so that his office can track the value of the unredeemed gift cards. 


TREE REMOVAL COMPANY BANNED IN ND

Attorney General Wayne Stenehjem has issued a cease and desist order banning Chris Gustafson of Becker, Minnesota, doing business as Nature’s Way Tree and Landscape, from engaging in contracting in North Dakota. 


STUDENT LOAN CONSOLIDATION SCAMS INVESTIGATED

Two California companies, Student Loan Counsel and Progress Advocates Group LLC, have been required to stop doing business in North Dakota after a joint federal and state investigation into fraudulent student loan consolidation and debt consolidation services.


MANITOBA AND MISSOURI APPEAL NAWS PROJECT RULING

The court battle over the Northwest Area Water Supply project unfortunately will continue, announced Attorney General Wayne Stenehjem. In August, the District Court in Washington, DC concluded that the Environmental Impact Statement for the NAWS project met the requirements of the National Environmental Protection Act. 


TWO UNLICENSED CONTRACTORS BANNED FOR FRAUD

The Consumer Protection division obtained civil judgments against Jeremy Meyer of Fargo, doing business as JM Construction & Design, and Cody Fleckenstein of New Salem, dba Prefab Plus, LLC, banning them from doing business in ND for the foreseeable future.


ATTORNEYS GENERALS ANNOUNCE MULTISTATE ACTIONS TO ADDRESS OPIOID EPIDEMIC

Attorneys generals across the nation have joined together on two separate actions to address the opioid epidemic that has reached crisis proportions, announced  Attorney General Wayne Stenehjem. “In North Dakota, there were 20 drug overdose deaths in 2013, and that number tripled to 61 in 2015,” said Stenehjem. “And it’s getting worse.”

Equifax urged to reimburse consumers for the costs of filing credit freezes.
Attorney General Wayne Stenehjem today joined with other Attorneys General from across the country in a letter to Equifax expressing serious concerns about the way it is responding to consumers in the wake of the massive data breach affecting 143 million people.
