CONSTITUTIONAL CARRY PROVISIONS

An individual who meets the qualifications for constitutional carry in North Dakota may carry a loaded gun in a vehicle but must provide law enforcement with the proper identification upon a traffic stop.


INJUNCTION ISSUED HALTING PROPOSED SANFORD-MID DAKOTA MERGER

Attorney General Wayne Stenehjem announced that the United States District Court for the District of North Dakota today issued a preliminary injunction blocking the proposed merger between Sanford Health and Mid Dakota Clinic until the Federal Trade Commission administrative hearing in January 2018. 


COMPASSIONATE CARE ACT SUBJECT TO CONSTITUTIONAL LIMITATIONS FOR AMENDMENTS

Although the Legislature repealed the initiated measure 5, the replacement Compassionate Care Act retains initiated measure status and any amendments within seven years would require a two-thirds vote of the Legislative Assembly. 


RETAILER SALES AND USE TAX RECORDS

Retailers who keep sales and use tax records for more than the minimum number of years required by law must provide those records to the Tax Commissioner, upon request, when the Tax Commissioner is conducting an audit of sales and use tax reporting.

Attorney General Wayne Stenehjem announced today that North Dakota consumers who were deceived into sending payments to scammers using Western Union's wire transfer service may be eligible for compensation from a $586 million fund that will be administered by the US Department of Justice.

Attorney General Wayne Stenehjem has issued a Cease & Desist order against an out of state moving company operating under several business names, for violations of the state’s consumer fraud laws. 


FRAUDULENT VEHICLE WARRANTY COMPANY BANNED IN NORTH DAKOTA

Attorney General Wayne Stenehjem issued a Cease & Desist order against Jason Rhoden of Santa Ana, California, doing business as Vehicle Protection Department, LLC, for violations of the consumer fraud and telephone solicitation laws. 


MORE UNLICENSED CONTRACTORS BANNED

The Consumer Protection division has obtained a civil judgment against two unlicensed contractors, Wayde Anderson and Shanda Anderson, doing business as WJA Builders, banning them from doing business in North Dakota. 


UNREASONABLE DELAY IN RESPONDING TO REQUEST

Even though the city of Mandan was busy with budget and other deadlines as well as dealing with numerous other record requests from the same requester, it was an unreasonable delay when the city took three weeks to respond that no records existed.
